Exclusive : Bombay High Court Case Status Page plays Hide and Seek, Litigant alleges ongoing Fraud in Registry

The Bombay High Court (HC) in India dealing with a criminal case for alleged Flight Safety violations runs into another controversy pertaining to listing the date of hearing

 

In the matter of Harpreet Singh and another vs State of Maharashtra, the complainant, one of the respondents and former employee of Air India Ltd., KVJ Rao was informed about the next date of hearing around 20 days in advance. The information was shared by the law firm Svarniti Law Offices representing the accused to appear in the Court in person on 4 January this year.

 

However, when Rao in less than 24 hours from the date of hearing; on the intervening night of 3 and 4 January visited the Bombay HC website twice to verify the date, the next date of hearing reflected completely blank.

Shockingly, in just a matter of few hours before 12 noon on 4 January, all of a sudden, most magically the date of hearing changed from blank to 4 January 2024 and the next date of hearing is now reflecting as 2 February 2024.

 

Rao says “This is not happening for the first time. This is deliberately and time and again done to get the order passed at my back and in my absence to subvert justice.”

 

The Revelation has viewed different screenshots of the Bombay HC Case status page provided by Rao.

 

The Bombay HC at the bottom of its website has mentioned a disclaimer that says

 

“PLEASE NOTE : Future dates in case of pre-admitted cases are computer generated provisional dates of listings except where Hon’ble Courts have given due dates. The provisional dates may change, subject to listing directions. Please monitor daily cause lists for confirmed listings.”

 

The Bombay HC in its Disclaimer somehow failed to mention the scenario in which a litigant should do when the date of hearing is left blank.

 

This given hide and seek played by the Constitutional Court pertaining to listing of dates not only educe a question mark on its integrity but also undoubtedly subverting justice, in particular when the matter pertains to Flight Safety violations.

 

Rao’s two emails addressed to the Chief Justice, Bombay HC - Devendra Kumar Upadhyaya, Registrar, Bombay HC - R.N Joshi and Chief Justice, Indian Supreme Court - Dhananjaya Y. Chandrachud narrating such ongoing incidents have so far not received any response.
